The Directorate of Vigilance and Anti-Corruption will be responsible for the enforcement of the Prevention of Corruption Act , 1988 (PC Act) as Amended in 2018 and the Indian Penal Code provisions of conspiracy or abetment of the offences as contained in the PC Act. All other offences involving Public Servants will be investigated by the Police Department.
Where offences of both the categories are involved, either the DVAC or the Police Department will handle the investigation, depending on the constitution of major offence.
The Central Bureau of Investigation (CBI) is empowered to investigate all offences notified by the Central Government under Section 3 of the Delhi Special Police Establishment Act. The CBI, under an administrative arrangement, is also empowered to investigate into cases, which are substantially and essentially against the Central Government employees or the affairs concerning the Central Government, irrespective of the fact that certain employees of the State Government are also involved. The CBI will inform the State Police of the fact and the latter will render necessary assistance for investigation.
Similarly, the cases which are essentially and substantially against Public Servants of the State Government or the matters concerning the State Government, the State agency including the DVAC will investigate the cases, irrespective of the fact that the Central Govt. employees are also involved. However, the State Agency will inform the fact of involvement of the Central Government Officials to the CBI, during investigation. The CBI will render necessary assistance to the State Agency, if necessary.
